How long does the trademark process take?

Can I trademark a logo and a name together?

When do I need to renew my trademark registration?

You need to renew your trademark periodically as required. If you miss the deadline by less than 6 (which can vary) months, you can still renew by paying an extra fee. Exceeding the deadline more than this time period will result in cancellation of registration.

What is a grace period?

The USPTO provides a grace period of six months after the deadline for filing required documents, such as maintenance fees or renewals, to keep your trademark registration active. During this time, you can still file the necessary paperwork with an additional fee. Failing to do so within the grace period can result in the cancellation of your trademark registration.

What is the difference between TM and the R within the circle ®?

The TM and SM symbols are governed by local, state, or foreign laws and indicate marks a party claims rights to. The federal registration symbol, ®, can only be used once the mark is registered with the USPTO. Even if an application is pending, ® cannot be used until the mark is officially registered. This symbol should only appear on goods or services covered by the federal trademark registration.Please Note: Some foreign countries use ® to show a mark is registered there, so its use by a foreign registration holder may be proper.
